To use OFFTRY, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities that occur under your account
• Notify OFFTRY immediately of any unauthorized account use

You are responsible for safeguarding your password and for all actions taken using your account. OFFTRY cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

OFFTRY provides AI-powered virtual try-on and related ecommerce services, including:

• AI virtual try-on generation
• Product synchronization from connected stores
• Store integration (Shopify, WooCommerce, Custom API)
• Widget embedding for ecommerce platforms

OFFTRY uses artificial intelligence to generate virtual try-on images for visualization purposes only. Results may vary and may not accurately represent the actual color, fit, size, texture, or appearance of a garment. AI-generated results should not be considered a guarantee of how a product will look or fit in real life.

OFFTRY does not guarantee that every generated result will be accurate, complete, or free from visual artifacts or errors.

As a merchant using OFFTRY, you represent and warrant that you have the necessary rights and permissions to:

• Upload and use product images
• Display logos and brand assets
• Provide garment images for AI processing
• Process customer photographs through OFFTRY
• Use all other content you provide to OFFTRY

OFFTRY is not responsible for any copyright infringement, trademark violation, or unauthorized use of content uploaded by merchants. You bear full responsibility for the content you submit.

When a customer uses the Virtual Try-On feature through your store, OFFTRY processes the customer's photograph to generate a virtual try-on result.

As the merchant, you are responsible for:

• Obtaining any required permission or authorization from customers before their images are processed
• Clearly disclosing to customers that their photographs will be processed by AI
• Ensuring compliance with applicable privacy laws and regulations
• Providing customers with appropriate privacy notices

OFFTRY offers the following subscription plans:

• Starter — Includes a 5-day free trial, after which payment is required to continue
• Basic — Monthly or yearly billing
• Pro — Monthly or yearly billing
• Enterprise — Custom negotiated pricing

Free Trial:

The Starter plan includes a 5-day free trial. A valid payment method may be required to start the free trial. After the trial period ends, you must pay to continue using OFFTRY. The free trial is limited to one per user, email address, payment method, device, or business.

Auto-Renewal:

Subscriptions automatically renew at the end of each billing period unless you cancel or disable auto-renewal. You can manage auto-renewal settings in your account dashboard.

Refund Policy:

All subscription fees are generally non-refundable once payment has been processed. However, OFFTRY may, at its sole discretion, issue a full or partial refund in the following cases:

• Duplicate charges
• Billing errors
• Significant technical issues affecting service delivery

To request a refund, contact us at offtry.pk@gmail.com within 7 days of the charge. Refunds, when approved, will be issued to the original payment method. Refund decisions are made at OFFTRY's sole discretion.

Cancellation:

You may cancel your subscription at any time through your account settings. Access continues until the end of the current billing period. No refunds are provided for unused time.

Failed Payments:

If payment is not received within 7 days of the due date, your subscription may be cancelled, and your store may be suspended.

Taxes:

All prices are in $ (United States Dollars) and may be subject to applicable taxes.

Usage Limits:

Each plan includes specified limits on products, try-ons, stores, team members, and widget loads. Exceeding these limits may require an upgrade.

To prevent misuse of our free trial, OFFTRY may limit or restrict multiple trial accounts associated with:

• The same user
• The same email address
• The same payment method
• The same device
• The same business
• Other identifying information

We may suspend or terminate trials where we reasonably believe the trial is being abused or used fraudulently.

The free trial is limited to 5 days per user, and the trial limit is strictly enforced.

A valid payment method may be required to start a free trial.

OFFTRY may suspend or terminate your account for:

• Non-payment of subscription fees
• Violation of these Terms of Service
• Misuse or attempted disruption of the Service
• Fraudulent or unlawful activity
• Security threats or attempted breaches
• Using OFFTRY in a way that creates a security or legal risk
• Excessive usage beyond plan limits

Where reasonably possible, we will provide notice before suspension, except where immediate action is necessary to protect OFFTRY, our users, or comply with applicable law.

Data Retention After Termination:

Upon termination of your account:

• Your account data (excluding email, invoices, and subscription details) will be deleted after 90 days
• Your email address may be retained to allow re-registration without going through the full registration process
• Invoices and subscription details are retained for legal and accounting compliance
• You may request deletion of your email address, but invoices and subscription details will be retained as required by law

Upon request, your email address can be deleted from our records, but invoices and subscription details will be retained for legal and accounting purposes.

OFFTRY Owns:

• OFFTRY software and platform
• OFFTRY brand, logo, and trademarks
• AI pipeline and infrastructure
• User interface and design
• Documentation and training materials

Merchant Owns:

• Their products and product images
• Their trademarks and brand assets
• Their content uploaded to OFFTRY

Generated Try-On Images:

For try-on images generated through a merchant's website or integration, OFFTRY does not claim ownership of the generated images. These images are processed solely to provide the virtual try-on service and are not stored by OFFTRY after processing. Merchants and their customers are responsible for ensuring they have the necessary rights to the images they upload.

Images generated through the OFFTRY Demo may be retained and used by OFFTRY for demonstration, testing, and service improvement purposes and remain subject to these Terms.

Watermark:

OFFTRY applies a watermark to generated try-on images on the Demo, Starter, and Basic plans. The watermark may be removed on the Pro plan and above. Merchants on eligible plans may customize or remove the watermark in accordance with their plan features.

OFFTRY depends on third-party infrastructure and integrations, including:

• Shopify (for Shopify integrations)
• WooCommerce (for WooCommerce integrations)
• AWS (cloud storage)
• Modal (GPU AI inference)
• AI model providers (e.g., FASHN VTON)
• Payment providers (manual verification)

OFFTRY does not guarantee the availability, reliability, or performance of third-party services. If a third-party service experiences downtime or disruption, OFFTRY is not responsible for resulting service interruptions.

To the maximum extent permitted by applicable law, OFFTRY and its directors, officers, employees, affiliates, contractors, service providers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, sales, business opportunities, goodwill, anticipated savings, or data, arising out of or relating to the Services or these Terms, even if OFFTRY has been advised of the possibility of such damages.

Without limiting the foregoing, OFFTRY shall not be responsible for losses arising from:

• Inaccuracies, defects, artifacts, or unexpected results produced by AI-generated content
• Temporary or permanent unavailability of the Services
• Failures or interruptions of third-party services, including hosting providers, cloud infrastructure, Shopify, WooCommerce, or AI infrastructure
• Unauthorized access to an account resulting from your failure to maintain the security of your credentials
• Merchant-provided content, including product images, trademarks, photographs, or other materials
• Actions or omissions of the merchant or its customers
• Circumstances beyond OFFTRY's reasonable control

The limitations in this section shall apply regardless of the legal theory on which the claim is based, including contract, tort, negligence, or otherwise.

These Terms of Service and any dispute, claim, or controversy arising out of or relating to these Terms or the use of OFFTRY shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles.

The parties shall first attempt to resolve any dispute arising from these Terms through good-faith negotiations.

If the dispute cannot be resolved through good-faith negotiations within thirty (30) days, either party may submit the dispute to the competent courts of Islamabad Capital Territory, Pakistan, and the parties agree to submit to the jurisdiction of those courts, to the extent permitted by applicable law.
